ON LIST OF ACTIVITIES REQUIRING A SPECIAL
PERMIT (LICENSE) AND OF THE BODIES TO ISSUE SUCH PERMITS (LICENSES)
With the aim of improving state management of the activities performed
by managing subjects (legal entities and individuals) the Cabinet of Ministers
DECIDES:
1. To approve the applied list of activities for which a special permit
(license) is necessary and of the bodies to issue such permits (licenses),
hereinafter -- the list.
2. To establish that all special permits (licenses) for performance
of the activities entered into the list approved by the present Enactment,
issued before the passage of the present Enactment, remain valid for the
whole period there had been issued for.
3. Ministries and other central management bodies, the regional and
Minsk city executive committees, the state concerns shall: - till October
1, 1995, in accordance with the list make necessary changes in the normative
acts in power that stipulate licensing the activities they are responsible
for; - provide dissemination to the subordinate enterprises and organizations
of the present Enactment and observance by them of the requirements established.
4. To acknowledge the decisions of the Government of the Republic of
Belarus according to the list applied invalid. Prime-Minister of the Republic
of Belarus M. Chigir List of activities for which a special permit (license)
is necessary and of the bodies to issue such permits (licenses) National
Bank Banking activities in accordance with the lists of types, the execution
of which requires a license in compliance with the legislation. Ministry
of Architecture and Construction Design and prospecting activities1 for
construction, expansion, reconstruction and capital repairs of I and II
classes of responsibility objects (including the design works concerning
restoration and conservation of monuments of history and culture), dwelling
houses of all types, as well as design of city-building and design-layout
documentation. Execution of building-installation and special works (except
the objects for which the licensing of the above works is executed by other
Ministries and other central managing bodies). Performance of topography
and geodesy works, mapping and air-photo works, as well of map-publishing
works. Ministry for Foreign Economic Ties Organization of international
tourism. Interior Ministry Manufacture of seals and stamps2. Production,
sale and repair of cold steel of non-military purpose, hunting rifles,
sports and gas guns, including gas balloons, and ammunition to them. Detective
activities. Guarding of individuals and property of individuals and legal
entities. Design, installation, adjustment and technical service of the
protection signaling means (excluding the individual means). Operation
of fire- and explosion-dangerous productions and objects with mass presence
of people, list of which is established by the Chief Department of Fire
Protection of the Interior Ministry. Design, installation, adjustment and
maintenance of automatic fire-fighting systems and smoke protection. Testing
for fire danger and flame resistance of substances, materials, products,
equipment and building constructions. Organization and operation of departments
responsible for prevention and fire-extinguishing at enterprises, in institutions
and organizations. Manufacture and capital repairs of fire machinery (machines
and equipment), appliances, rescue devices, apparatus of individual protection,
fire-extinguishers, fire-extinguishing substances and other fire protection
means, wholesale of the above products. Manufacture of fire-protective
compounds and works with usage thereof. Ministry of Health Manufacture
and sale of bacteriological, psycho tropic, narcotic, strong and poisonous
substances. Stationary treatment of patients with infectional, cancerous
and psxychology diseases. Production and sale of medicine means, as well
as growing, storage (purchase), processing and sale of medicine plants.
Medical practice (except stationary treatment of patients with infectional,
cancerous and psychology diseases). Education at higher and medium educational
institutions, at the courses, retraining and qualification improvement
of medical profile specialists under the license of the Ministry of Education
and Sciences to organize the respective educational institution or courses.
Ministry of Culture and Printing Publishing activities. Production of cinema
and video products (shooting), copying and demonstration. Ministry of Defense
Design, manufacture, sale and repairs of armaments and ammunition, protection
means, military machinery and spare parts, components and devices to them,
if they are not used in other branches, as well as special materials and
special equipment to produce such. Design, manufacture, sale and repair
of missile-space complexes, communication and control systems for them.
Liquidation (demolition, utilization, burial) and processing of liberated
military and technical means and ammunition, design of special technologies
and equipment for these purposes. Scientific and research works and fundamental
investigations to create armaments and military technique. Ministry of
Education and Sciences Organization of schools, colleges, lycees, gymnasiums,
medium special and higher educational institutions, as well as educational
institutions (departments) to retrain and increase the qualification of
personnel. Ministry for Management State Property and Privatisation Activities
of specialized investment funds accumulating the nominal privatization
"Property" coupons. Organization and holding auctions and competitions
to sell property rights and other objects of state property. Ministry for
Emergency and Population Protection from Chernobyl Implications Control
over radioactive contamination of the natural environment, food products
and household articles. Committee to Supervise Safety Works in Industry
and Nuclear Energy Design, manufacture, processing, storage, application,
transportation (transit including), sale of industrial explosives. Design,
manufacture, processing, storage, application, transportation (transit
including), sale of radioactive materials and products on their basis,
as well as transportation (including transit), storage (warehousing) and
burial of radioactive wastes. Design, building, manufacture, installation,
adjustment, diagnostics, operation, repair and maintenance of radiation
devices and machines and objects of nuclear energy. Design, manufacture,
installation, launching works, diagnosing, operation and repair of boiler
supervision objects, weight lifting machines and mechanisms, high pressure
equipment and devices, lifting machines in mines, geology investigation,
oil processing, drilling and foundry for disposing liquid metals and electric
equipment for chemical and mining production and processes, where evolvement
of explosive ambient is possible. Design, construction, operation of productions
and objects where evolvement of explosion ambient is possible (mixtures
of gases, vapours and dusts with air and other oxidizers; compounds prone
to explosion transformations), as well as productions and objects with
harmful substances, storage and transportation (including transit) of such
substances. Design, construction, adjustment, diagnostics, operation and
repair of pipe-lines. Design, construction, operation of steel and steel-melting
productions. Design, construction, adjustment, diagnostics, operation and
repair of gas-supply equipment and systems, manufacture articles for them.
Design and execution of mountain, geology investigation, mining, industrial
geo-physical works, operation of deposits of natural minerals. Design of
mining productions and objects to extract minerals, including potable and
mineral ground waters, medical mud, as well as special underground constructions
not connected with the extraction of minerals. Construction, installation,
adjustment and repair works, executed on the objects controlled by the
Committee. Professional training in the system of professional education,
at enterprises and organizations, private educational institutions of the
personnel from the supervised objects and productions4. Ministry of Natural
Resources and Environment Protection Processing, burial (storage) and transportation
of toxic wastes from production and consumption, as well as pesticides
(with the expert conclusion of the Ministry of Health). Industrial procurement
(purchase) of wild nature plants (their parts), marshrooms, technical and
medical raw materials of plant origin with the aim of their industrial
processing or sale. Exploitation of deposits of peat bogs and sapropels.
Using the world of wild nature (except fishing resources). Committee for
Fishery Protection Execution of fish and other water works in natural reservoirs,
as well as organized paid amateur fishing. Committee on Land Resources
Setting (restoration) the borders of land estates of the owners, landowners
and land users, as well as of guarded territories. Making documents on
extraction and providing land estates into property, ownership and usage.
Making documents, establishing property rights, rights of ownership and
usage of land. Ministry of Posts and Informatics Usage of radio frequency
resource and technical means with radio radiation outside the bands, assigned
for free usage. Design, construction, operation of networks, systems and
construction of communications and informatics. Provision of services of
communication and informatics. Ministry of Agriculture and Food Products
Planting, cultivation and sale of cultures containing narcotic and poisonous
substances. Veterinary practice. Production of food alcohol, alcohol-containing
liquid food extracts, wine, beer, vodka, liqueur, cognac and tobacco products.
Design, construction, expertise, operation and capital repair of objects
of hydro-technology and melioration. Ministry of Fuel and Energy Installation,
adjustment, diagnostics, repair and operation of electric stations, block-stations
and electric networks, electric and heat-mechanical equipment (except the
objects of boiler supervision) for them. Ministry of Transport and Communications
Transportation of passengers and cargo (except proper technology needs
of the managing subject and urban trips by automobile transport) by automobile,
railway, river and sea transport, as well as transport-forwarding activities.
Repair and technical service (except proper needs of the managing subject)
of transport means of automobile, railway, river and sea transport, its
assemblies and aggregates. Construction, testing, maintenance, repair and
reconstruction of railway and water transport routes, artificial constructions
on them, as well as engineering constructions on water and railway transport.
Ministry of Labour State Migration Service of the Ministry of Labour Attraction
of foreign labour to the Republic of Belarus. Employment of citizens of
the Republic of Belarus abroad. Ministry of Finance State Inspection of
Assay Supervision Usage in production and processing, purchase, sale, storage,
diagnostics and evaluation, expertise of precious metals and stones, pearl,
amber in all types and states5. Manufacture, including placing orders at
others managing subjects, repair (restoration) jewelry, consumer and other
products from precious metals and stones, pearl, amber, sale of them, storage
and receipt into pawn. Committee for State Marks Production of state marks,
forms of securities and documents having a certain degree of protection,
special materials to protect them from forgery. Committee on Precious Metals
Extraction, collection, processing of precious metals and stones from scraps
and wastes. Extraction, processing and usage in production of water-seasoned
oak and amber. Inspection on Securities Performance of professional and
joint-stock activities with securities, as well as with state securities.
State Insurance Supervision Performance of each type of voluntary and compulsory
insurance and re-insurance. Insurance mediation (activities of insurance
brokers in insurance of life, pensions, medical insurance, property insurance
for population and insurance against accidents, insurance of the property
of legal entities and re-insurance). Ministry of Justice Private notary
practice. Barrister practice and juridical services, except private notary
practice, professional protection of rights and legal interests of individuals
and legal entities in criminal, civil cases and cases on administrative
violations at proceeding and court bodies6. Ministry of Social Protection
Delivery of pensions and grants. State Customs Committee Activities as
customs agents. State Committee on Aviation Usage of air lines together
with air-ports of the Republic of Belarus. Usage of aviation for aviation
works. Operation, technical service, repair, design and production of aviation
techniques. State Center for Information Security of the Security Council
of the Republic of Belarus Design, production, sale, installation, adjustment,
service maintenance of hard and software for information protection and
control of protection, special materials and equipment to manufacture the
above means, soft and hardware means of protecting from non-authorized
access, including application of cryptography means. Performance of special
investigations of technical means against leakage of information, works
to detect devices of scanning data and control over its protectiveness.
Committee for State Security Design, production, sale, operation and repair
of cipher technique. Audit Chamber Audit activities. District and Town7
Executive Committees Retail trade and trade-production activities. Retail
and wholesale trade of alcohol and tobacco products. Organization of pawns8.
Exploitation of archeology works (with the expert conclusion of the Institute
of History of the Academy of Sciences of the Republic of Belarus). Organization
and operation of shooting galleries, skittle-alleys, casinos, halls with
playing machines, totalizators (for each object). Urban trips by automobile
transport.
1. Licensing the investigation activities is performed with the license
to perform topography and geodesy works (paragraph 3 of this part of the
present list) on the territories assigned for construction.
2. Except military regiments and institutions of the Defense Ministry,
Committee for State Security and Chief Department of Border guards, the
order of making seals and stamps for them is determined by the central
managing bodies mentioned.
3. Except the objects of Ministry of Defense, Interior Ministry and
Chief Department of Border guards which are controlled by the respective
services of the above central managing bodies.
4. Except the activities, licensed by the Ministry of Education and
Sciences.
5. Usage of precious metals and compounds thereof exclusively for analysis
and activation of the printed circuit boards are not subject to licensing.
6. With a license for barrister practice there is no need to have a
license for juridical services, a license for juridical services gives
no rights to execute the barrister practice.
7. In towns with districts the licenses are issued by the town executive
committee.
8. In operations with precious metals and stones, pearls, amber, water-seasoned
oak and articles therefrom or decorated with them a license from the Committee
on Precious Metals of the Ministry of Finance is necessary. List of Invalidated
